Purchasing & Logistics Policy
1. Payment Terms
All payments are made in full to Vakar Studio LLC. Accepted methods: Bank Wire Transfer, and ACH for U.S. bank accounts; international buyers are invoiced via wire transfer only. Listed artwork prices do not include sales tax. New York State sales tax is added to the invoice as a separate line item where required by law (deliveries within New York State and studio pickups). No New York sales tax applies to artwork shipped to a destination outside New York State; any use tax obligations in the destination state or country are the sole responsibility of the buyer.
Title to the artwork passes to the buyer, and the artwork is released for delivery or pickup, only upon receipt of cleared funds for 100% of the purchase price. Where Studio-Managed Shipping is selected, dispatch begins only after full payment of both the artwork invoice and the separately issued logistics invoice (shipping, custom crating, and transit insurance).
An invoiced artwork is reserved for 5 business days. If cleared funds are not received within this period, Vakar Studio LLC may release the artwork for sale without further notice.
2. All Sales Final
Original artwork is a unique, one-of-one physical object. All sales are final. Vakar Studio LLC does not accept returns, exchanges, or refunds, except as provided under the transit-damage procedure in Section 3. Artwork colors may render differently on individual screens; on-screen appearance is not grounds for refund or claim.
3. Shipping, Handling & Transfer of Risk
The purchase price does not include shipping, crating, or transit insurance; these are calculated individually and invoiced separately. Worldwide shipping is available. In every scenario below, Vakar Studio LLC's responsibility for the artwork ends at the moment of transfer defined for that scenario.
Local NYC Hand-Delivery. Complimentary within New York City after receipt of full payment. Risk of loss passes to the buyer at the moment of physical handover at the destination, confirmed by a signed Delivery Receipt.
Local Pickup. By prior arrangement. Risk of loss passes to the buyer at the moment the artwork leaves the studio premises, confirmed by a Handover Protocol signed prior to removal. Buyer's transport of the artwork is entirely at the buyer's risk.
Studio-Managed Shipping (Domestic & International). The studio arranges professional art handling, custom wooden crating, and transit insurance, billed via separate invoice. The buyer or their authorized agent must sign the carrier's Proof of Delivery (POD). Transit damage must be reported in writing within 48 hours of documented delivery, with photographs of the artwork and all packaging; original packaging must be retained until the insurance claim is resolved. Absent such a report within 48 hours, the artwork is deemed accepted and the transaction closed. Remedies for transit damage are limited to the proceeds of the transit insurance policy.
Client-Managed Freight. The buyer may arrange their own carrier. Risk of loss passes to the buyer at the moment the packed artwork is transferred to the buyer's designated carrier at our facility. Vakar Studio LLC bears no responsibility for damage, environmental or thermal deformation, delay, or loss in transit handled by the buyer's carrier.
4. International Orders: Customs & Import Charges
All import duties, tariffs, VAT/GST, brokerage, and customs clearance fees of the destination country are paid solely by the buyer. These charges are never included in the artwork price or the shipping invoice. If a shipment is refused, abandoned, or returned due to the buyer's failure to pay import charges or provide required customs information, the buyer is not entitled to a refund; any return shipping and re-crating costs are the buyer's responsibility.
5. Limitation of Liability
To the maximum extent permitted by law, Vakar Studio LLC's total liability under any order is limited to the amount actually paid for the artwork, and Vakar Studio LLC is not liable for indirect, incidental, or consequential damages of any kind.
6. Documentation
Every artwork is accompanied by a signed Certificate of Authenticity from Vakar Studio.
7. Governing Law & Venue
This policy is governed by the laws of the State of New York. Any dispute arising from a purchase shall be resolved exclusively in the state or federal courts located in New York County, New York.
